Consent to Electronic Delivery of Communications and E-Sign Disclosures

By consenting to the terms and conditions of this Consent to Electronic Delivery of Communications and E-Sign Disclosures (this “Agreement”), you agree that we may, at our option, provide Communications to you in electronic form, including making them available to you in electronic form. We may do so by: (1) posting the Communication on our Internet site; (2) sending the Communications to the email address you provide to us; or (3) sending you an email, text message, or push notification to the telephone number you provide to us for your Access Device. Your Internet service provider or wireless service provider may charge you fees or other costs for sending or receiving Communications by email or text message. You agree that you are responsible for all such fees and costs. Any Communications that we send you or that you send us may not be encrypted. The categories of Communications include information pertaining to your loan application, authorization to receive consumer reports, loan servicing, online payment authorization, and/or any other service we may offer you.

This Agreement allows Change Lending, LLC d/b/a Change Home Lending and its agents, representatives, affiliates, successors, and assigns (collectively “Change Lending”) to provide you with electronic versions of important notices and documents associated with applying for and/or obtaining a loan from Change Lending. Certain laws and regulations require us to provide notices and disclosures to you in “writing”(traditionally this is defined as a paper notice); with your consent, the E-SIGN Act allows us to provide these documents to you electronically.

Definitions

The words “we,” “our,” and “us” mean Change Lending and its agents, representatives, affiliates, successors, and assigns.

The words “you” and “your” mean each applicant, borrower, and co-signer.

“Access Device” means any electronic device you use to access your account and view Communications. This includes, but is not limited to, a traditional computer, such as a desktop or laptop computer, or a mobile device, such as a tablet or a smartphone.

“Communications” means all application documents, monthly statements, disclosures, notices, messages, records, terms and conditions related to the loan application and loan agreement, alerts and reminders, and other information that we may Deliver to you concerning your Account, your Loan, or the Services. Communications includes all materials required for the initial loan application and any subsequent materials, disclosures, notices messages or other information relating to the loan.

“Deliver” means received by you on the date it is posted on our Internet loan site, made available, or sent to you as provided in this Agreement.

Scope of this Agreement

This Agreement applies to all Communications related to the loan application, loan origination, and servicing of your loan at Change Lending. This consent will remain effective through the account application process to the account closure or until the consent is expressly withdrawn by you. Your consent does not mean that we must provide documents electronically but instead that we may deliver some or all of those documents electronically.

Your Consent to Electronic Delivery of Documents

You agree that all Communications covered by this Consent may be provided to you or made available to you in electronic form. Communications will be delivered to you within the application process in a .pdf document. You must download and open the Communications to proceed with your application and you are strongly encouraged to save or print the documentation for future reference. If your application is approved, any additional disclosures, notices, or periodic statements may also be provided to you in a similar electronic format. You further agree that we may Deliver Communications to you by email, text message, or push notification. We may also, at our option, choose to physically mail you any Communication that we may provide to you electronically. Your consent to electronic Delivery ofCommunications is effective until you withdraw it.

Requesting Paper Copies of Documents Presented Electronically

You agree and understand that paper versions of electronically presented documents may not be mailed unless you specifically request it. To request a paper copy of any Communication, contact us at legal@changemtg.com. Copies of Communications will be mailed at no charge.

Access Device Requirements

By consenting to this agreement, you confirm that your Access Device meets the minimum specifications and requirements necessary to view and retain Communications.

To access your Communications on a mobile device, you will need:

§ A mobile device with any of the following operating systems: Android or iOS (iPhone).

§ A data plan provided by your wireless carrier or Wi-Fi Internet access and an up-to-date mobile internet browser that is compatible with, and supported by, your operating system (e.g., Chrome or Safari).

§ If you wish to view .pdf files on your mobile device, you will need software that accurately reads and displays .pdf files (such as the mobile version of Adobe Reader).

§ A printer and/or storage device to print or retain any Communications.

To access your Communications on a traditional computer, you will need:

§ A computer with any of the following operating systems: Windows XP or higher, OSX or higher.

§ An internet connection and an up-to-date internet browser that is compatible with, and supported by, your operating system (e.g., Edge, Firefox, Google Chrome, or Safari).

§ Software that accurately reads and displays .pdf files (such as Adobe Reader).

§ A printer and/or storage device to print or retain any Communications.

Changes to Access Device requirements

We will notify you if our hardware or software requirements change and whether that change creates a material risk that you would not be able to access or retain your Communications. Continuing the application process after receiving notice of the change is the reaffirmation of your consent to this Agreement.

Maintaining a Valid Email Address

It is important that you maintain a valid email address so that we may contact you regarding your account. You agree to maintain a valid email address and promptly notify us of any changes to your email address. You may update your email address during the application process later by contacting us at legal@changemtg.com.

Withdrawal of Your Consent

You have the right to withdraw your consent to receive Communications in electronic form at any time.

To withdraw your consent prior to completing your application, simply exit this session prior to accepting this Agreement.

To withdraw your consent after you have already submitted your application, you must contact us at legal@changemtg.com.

If you withdraw your consent to this Agreement:

§ You will no longer receive the electronic presentment of any documents and you cannot use the online services. Withdrawal of your consent will have no legal impact on the effectiveness, validity, or enforceability of any Communications that were Delivered to you in electronic form before the effective date of your withdrawal.

Multiple Access Devices

Your acceptance of this agreement on one Access Device constitutes your acceptance on all Access Devices you use. For example, if you view and accept this agreement on a mobile device, the terms of this Agreement will apply to Communications accessed on a traditional computer (or vice versa).

Additionally, by viewing and accepting this agreement on any Access Device, you are reasonably demonstrating your ability to access and view Communications in the format that the services are provided on that Access Device and all subsequent Access Devices. If you change Access Devices (or use multiple Access Devices), it is your responsibility to ensure that the new Access Device meets the applicable system requirements and that you are still able to access and view Communications on the subsequent Access Device. Continuing your application on other Access Devices is your reaffirmation of this Agreement.

Please contact us at legal@changemtg.com if you have difficulties accessing or viewing Communications on your selected Access Device.

Acceptance

You will be asked to acknowledge your acceptance of these terms by checking the box before you are able to continue with your application. In doing so, you are confirming that you meet the system requirements described above, that you have demonstrated your ability to receive, retain, and view Communications on your Access Device, and that you have an active and valid email address to receive communications from us.
